Terms of Use — Glowcast

Please read carefully. These Terms are a binding agreement between you and AppFusion. By downloading or using Glowcast, buying a subscription or joining our waitlist, you agree to them. If you do not agree, do not use the Services. Photosensitivity warning: some shows contain flashing lights. See Health and safety.

These Terms of Use (the “Terms”) govern your use of the Glowcast app (the “App”), the glowcast.cam website (the “Site”) and related services (together, the “Services”) provided by AppFusion (“AppFusion”, “we”, “us”). These Terms are the end-user licence agreement (EULA) for the App. Our Privacy Policy explains how we handle personal data.

Who can use Glowcast

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf.

Your licence to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, as permitted by the usage rules of the App Store or Google Play. You may not:

copy, modify, or create derivative works of the App, except as the law allows;
reverse-engineer, decompile or disassemble the App, except to the extent this restriction is prohibited by law;
extract, resell, sublicense or redistribute templates, effects, music, artwork or other content from the App as standalone assets;
circumvent any purchase, watermark or technical protection; or
use the Services in a way that breaks the law or these Terms.

Using your shows. You may display shows you create with Glowcast at your home, your business or an event, including in public view, as long as you follow Projecting responsibly. The licence to display templates ends when your access to them ends, except for clips and loops you have exported while entitled, which you may keep playing for your own display purposes.

Free features, Glowcast Pro and purchases

Glowcast is free to download and includes free features and starter templates. Some free features add a small watermark to the projector output. Glowcast Pro unlocks additional templates and features and is available as:

Pro Monthly and Pro Yearly: auto-renewing subscriptions;
Season Pass: a one-time purchase that unlocks Pro for 60 days and does not renew; and
Lifetime: a one-time purchase that unlocks Pro for as long as we offer the App.

Prices are shown in the App before you buy and may vary by country.

Auto-renewing subscriptions

Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
Manage or cancel: on iPhone or iPad, open Settings → [your name] → Subscriptions. On Android, open the Google Play app → Profile → Payments & subscriptions → Subscriptions. Deleting the App does not cancel a subscription.
When you cancel, Pro stays active until the end of the period you have paid for.

Free trials and introductory offers

If a free trial is offered (for example, a 7-day trial of Pro Yearly), it is available once per person. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you are charged the full price shown at purchase. On Apple devices, any unused part of a free trial is forfeited if you buy another subscription. We will remind you before a trial ends when the store allows us to.

Price changes

We may change subscription prices. The App Store or Google Play will notify you and, where required, ask for your consent before a price increase applies to you.

Refunds

Purchases are processed by Apple or Google, who handle refunds under their own policies. To request a refund, use Apple’s Report a Problem or Google Play’s refund process. This does not affect any statutory rights you have, such as the right of EU and UK consumers to withdraw from certain purchases.

You can restore purchases on another device signed in to the same store account using Restore purchases in the App. Where we enable Apple Family Sharing for a product, eligible family members can use it under Apple’s rules.

Templates, updates and availability

We regularly add templates and may update, replace or retire templates, effects or features, including seasonal content that is available only for a limited time. We try to keep templates you have customised working, but we do not guarantee that any particular template or feature will remain available. Pre-release or “beta” features are provided as they are and may change or be removed.

Your content

Text, photos, logos and other material you add to Glowcast (“Your Content”) remain yours. Your Content is stored on your device (and in your iCloud if you enable backup); we do not receive it unless you send it to us, for example in a support request. In that case, you allow us to use it only to help you.

You are responsible for Your Content and confirm that you have the rights needed to use it, including any people’s permission to show their image and the right to display logos or artwork you add.

Projecting responsibly

You are responsible for how and where you project. When using Glowcast you agree to:

follow all laws, regulations, homeowners’ association rules and local ordinances on outdoor lighting, displays, noise and public nuisance;
get permission before projecting onto property you do not own or control;
never project onto roads, vehicles, aircraft or waterways, or in any way that could distract or dazzle drivers, cyclists, pilots or boat operators;
never point a projector into anyone’s eyes, and keep children and pets away from hot or bright projector lenses;
not project unlawful, hateful, harassing, sexually explicit, or infringing content; and
turn off or adjust your display if asked to by authorities or affected neighbours.

Health and safety

Photosensitivity warning. A small number of people may have seizures or other reactions when exposed to flashing lights or patterns, even without a history of epilepsy. Shows with rapid flashes are labelled in the App, and you can turn on Reduce flashing in settings. Stop immediately and seek medical advice if you or a viewer feels dizzy, has altered vision, eye or muscle twitching, disorientation or any involuntary movement.

Equipment and weather. Projectors, adapters, cables and extension leads are not supplied by us. Follow the manufacturer’s instructions, use weatherproof equipment and outdoor-rated power outdoors, secure equipment against tipping and theft, and never leave equipment in conditions it is not designed for.

Third-party hardware and services

Glowcast works with third-party projectors, adapters, AirPlay, Android TV and other products and services that we do not control. We are not responsible for their availability, performance or compatibility, and their own terms apply. Projection results depend on your projector’s brightness, resolution and placement, the surface and ambient light.

The Site and waitlist

Joining the waitlist does not create an obligation to buy. We may contact you about the launch as described when you signed up, and you can unsubscribe at any time. Information on the Site, including planned features, release dates and pricing, may change before launch.

Intellectual property

The Services, including the App, templates, effects, artwork, music, the Glowcast name and logo, are owned by AppFusion or its licensors and are protected by intellectual property laws. Except for the licence above, no rights are granted to you. If you send us feedback or ideas, we may use them without obligation to you.

Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

Limitation of liability

To the fullest extent permitted by law, AppFusion will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or property (including damage to projectors or other equipment), arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim and US $50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in the EU or UK, you keep the protections your local law gives you.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless AppFusion from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your projection displays, or your breach of these Terms or the law.

Suspension and termination

You can stop using the Services at any time. We may suspend or end your access to the Services if you materially breach these Terms or if we must do so to comply with the law. On termination, the licence in these Terms ends, but sections that by their nature should survive will remain in effect. Cancelling a store subscription is done through your store account as described above.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in Delaware. If you are a consumer living in the EU, the UK or another country whose laws give you the right to bring claims in your local courts or under your local law, nothing in these Terms takes away that right.

App Store terms (Apple)

If you downloaded the App from Apple’s App Store, the following also applies:

Acknowledgement. These Terms are between you and AppFusion only, not Apple. AppFusion, not Apple, is solely responsible for the App and its content.
Scope of licence. Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
Maintenance and support. AppFusion is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
Warranty. AppFusion is solely responsible for any product warranties not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product claims. AppFusion, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
Intellectual property. If a third party claims that the App or your use of it infringes their intellectual property rights, AppFusion, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Developer contact. Questions, complaints or claims about the App can be sent to AppFusion at support@glowcast.cam.
Third-party terms. You must comply with applicable third-party terms (for example, your wireless data service agreement) when using the App.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple has the right to enforce them against you as a third-party beneficiary.

Google Play terms

If you downloaded the App from Google Play, purchases are also subject to the Google Play Terms of Service. Google is not responsible for the App or its content.

Changes to these Terms

We may update these Terms. We will post the new version here with a new “Last updated” date and, for material changes, give you notice in the App or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.
